Notary Public or Commissioner of Oaths?

In Ontario, Canada, a Notary Public and a Commissioner of Oaths are two distinct legal roles with different powers and responsibilities. A Notary Public holds a legal appointment and is authorized to administer oaths or affirmations and witness the signing of various documents, including affidavits, deeds, statutory declarations, and other conveyances. They have the authority to verify a person’s identification and confirm the authenticity of documents as true copies. On the other hand, a Commissioner of Oaths ensures that oaths or affirmations are administered in compliance with the law. They certify that the proper process of administering the oath or affirmation has been followed, but they do not certify the accuracy or truthfulness of the information contained in the documents. It is important to note that while every lawyer in Ontario is considered a Commissioner of Oaths, not every lawyer is a Notary Public.

Here is a list of various document types that may require notarization or a Commissioner for Oaths:

  • Educational transcripts
  • Court or legal documents
  • Declarations
  • Marriage or divorce certificates
  • Powers of Attorney
  • Birth or death certificates;
  • Professional or business documents
  • Medical records
  • Adoption or name-change papers
  • Immigration & Visa documents
  • Permits
  • Letters
  • Invitations
  • Wills & Trusts
  • Property documents

Additionally, there are numerous other document types that may also require notarization. It is important to consult the relevant authorities or legal professionals to determine the specific requirements for notarization of your particular document.

Required Documentation for Your Appointment

To ensure a smooth and efficient process, please bring the following documentation to your appointment:
  1. Two pieces of valid identification:
    • One government-issued photo ID, such as a driver’s license, passport, citizenship card, or permanent resident card.
    • The second piece of identification can be another photo ID as mentioned above, or a signed credit card or SIN card.
  2. The document requiring notarization:
    • Please ensure that all relevant information is filled in before your visit to our office.
    • Kindly refrain from signing the document in advance.
By providing the necessary identification and ensuring the document is appropriately prepared, you will help facilitate the notarization process effectively. Our team at Pegasus Law is dedicated to delivering reliable and professional services, and we appreciate your cooperation in meeting these requirements.
